| The Copyright law of the United States (Title 17, United States Code) governs the making of photocopies or other reproductions of copyrighted materials. Under certain conditions specified in the law, libraries and archives are authorized to furnish a photocopy or other reproduction. One of these specified conditions is that the photocopy or reproduction is not to be used "for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of fair use, the user may be liable for copyright infringement. This institution reserves the right to refuse to accept a copying order if, in its judgment, fulfillment of the order would involve violation of the copyright laws. |

| GUIDELINES REGARDING FAIR USE |
| The four questions to ask are: |
|
- What is the purpose of the intended use? Is it educational, non-profit, transformative?
- What is the nature of the work? Is it published, factual?
- How much of the piece will be used? A small amount, which is not the "heart" of the work?
- What will the effect be on the market for the original work? Little to none?

| See Fair Use Checklists (one from the Copyright Advisory Office, Columbia University, and another from the Copyright Information Center, Cornell University), which identify those factors favoring or opposing fair use. |

| The four fair use guidelines for Reserve and eReserve materials are: |
- Brevity: Generally speaking, a faculty member may submit a single chapter from a book, a single article from a journal issue, a short story, an essay, a short poem, a chart, a diagram, etc. The article, chapter, short story, or essay should not exceed 2500 words. A poem should not exceed 250 words.
- Spontaneity: Photocopied materials may be placed on reserve for one semester. The library will stamp a copyright notice on the first page of photocopied materials. Any item returned to you at the end of the semester with a red copyright warning stamp will not be placed on reserve again without written copyright permission. If the professor requires that the materials be on reserve for two or more semesters, permission must be obtained from the copyright holder.
- Cumulative Effect: The copies will be used in only one course, and not more than one short poem, article, story, essay or two excerpts may be copied from the same author, nor more than three from the same collection.
- A Notice of Copyright must be included on each copy.

| Print Reference Sources |
| Subject encyclopedias and other printed basic information sources in the Neumann Library reference collection can be sources of plagiarized work. These are shelved on the first level of the library. |
